By purchasing the Experience, the Customer declares to be aware of and accept the following General Conditions.

1- OBJECT

This remote contract, which through the use of the MYFassa Plus platform the Customer enters into with MarshYellow di Daniele Schimizzi, has as its object the provision and participation in live or remote Experiences.
The Customer, after purchasing the product and having credited the registration fee paid, will receive the link and credentials to access the Experience at the e-mail address indicated during registration.

2- PRE-CONTRACTUAL INFORMATION

The Customer declares to have read, prior to the online purchase of the product, all the information contained in the card relating to the description of the Experience, accessible on the website www.myfassaplus.com, and from which the main characteristics of the product are evident. , the geographical address, the identity of the Host, the price and payment methods.

3- CONCLUSION OF THE CONTRACT

Pursuant to and for the purposes of art. 1326 of the Italian Civil Code, this remote contract is intended as finalized when MarshYellow di Daniele Schimizzi, through its MYFassa Plus platform (and for it the operators responsible for receiving data and communications relating to the conclusion and execution of the contractual relationship) , is aware of the Customer’s adhesion to the Experience, manifested with his / her online registration and with the regular payment of the relative purchase amount.
After completing the registration procedure and full payment of the relative fee, the Customer receives the necessary credentials to access the telematic platform. The credentials to access the Experience will not be sent to the Customer in the event of failure to complete the payment or, if already transmitted, they will be revoked.
When purchasing the Experience, the Customer must declare that he wishes to purchase the event registration, subsequently losing this right.

4- PROVISION OF THE SERVICE

The MYFassa Plus platform has been designed in such a way as to offer all possible users maximum compatibility with the most common systems available. Tests were carried out on all the most popular platforms (Mac OS, Windows, Linux) and on the main browsers (Internet Explorer, Mozilla Firefox, Google Chrome, Apple Safari).

The required hardware and software requirements are minimal and are generally met on a standard standard home system. In order to make the most of the multimedia contents and related online services, you must have:
– a connection to the Internet (ADSL, optical fiber or 3G or higher cellular connection);
– one of the main browsers available regularly updated;
– any of the following devices: PC, Mac, IOS or Andorid smartphone and tablet;
– earphones, headphones or speakers and microphone (built-in or connected via cable or Bluetooth).

5- RESPONSABILITY AND OBLIGATIONS

The Customer, in using the Experience purchased and made available by the MYFassa Plus platform, undertakes not to sell the product to third parties and to carry out and / or participate in the activities personally.
It is expressly forbidden to replace a person and to use any device suitable for unduly facilitating the Customer.
Any behavior contrary to good faith by the Customer, as well as the violation of the aforementioned obligations and prohibitions, the list of which is to be considered non-exhaustive, will give MYFassa Plus the right to interrupt the provision of the service.
The Customer expressly exonerates MYFassa Plus from any liability for direct and indirect damages, to the person or not, that the Customer or third parties may suffer in relation to or depending on the provision of the chosen Experience, or as a result of the interruption of the operation, as well as direct and indirect damage:
– that the Customer or third parties may in some way blame for the failure to provide connectivity by the telecommunication network operator, or even for the Customer’s use of connectivity (not high-speed) technically incompatible with the Service, if all this is due to failure to meet the minimum system requirements referred to in Art. 4, whose verification is the responsibility of the Customer;
– caused by third parties who illegally accessed the online Experience due to the Customer’s lack of caution in custody of the login and password assigned to him, or due to the absence of other security measures that the Customer is required to take.
In no case MYFassa Plus will be held responsible:
– for the malfunction of the Service deriving from breakdowns, overloads, interruptions of the telephone lines, electricity or referred to the Internet network;
– for non-fulfillment by third parties that affect the use of the Service, including, by way of example, slowdowns in speed or the failure of the lines telephones and computers that manage the electronic traffic between the Customer and the educational platform from which the Service is provided;
– for any fraudulent and / or improper use of credit cards by the Customer;
– for non-fulfillment by the Host and not due to force majeure or justified reasons.
The Customer, with the purchase of the Experience and the acceptance of these General Conditions, consciously, voluntarily and freely assumes all the risks, both known and unknown, related to participation in the Experience, with reference to which the full and sole responsibility.

6- CONDITIONS OF WITHDRAWAL AND REFUNDS

The Customer has the possibility to cancel the Experience purchased, requesting its withdrawal, within 48 hours before the scheduled start time. In this case, you will receive a full refund.
The cancellation and refund request must necessarily be sent in writing by e-mail to experience@myfassaplus.com.
Any request for reimbursement of the Experience purchased can be followed up only if the withdrawal is received within the aforementioned term and in the manner indicated above, regardless of the reasons given.
In the event of failure to reach the minimum number of participants required for the chosen Experience, the Customer will be informed within 24 hours prior to the start time of the Experience and will receive a full refund. Alternatively, you can choose to receive a discount code and use the credit for another scheduled experience of the same type as soon as the minimum number is reached, or for a different experience of another type.
The refund may consist, at the Customer’s choice, in the return of the amount paid or in the issue of a discount code equal to the value of the amount paid, which will be valid for 30 days from the date of sending and can be used for the purchase of other Experience. The discount code will be sent by e-mail to the address provided by the Customer when purchasing the Experience.
The Customer can change the Experience purchased with reference to the date, time or the addition or removal of participants, within 48 hours before the established start time.
In the event that the changes result in an increase or decrease in the purchase price, the Customer will have to regularize these circumstances during the modification, by integrating the amount paid or requesting a refund for the difference. Otherwise the changes made will not be perfected.
In addition to the cases of withdrawal and cancellation of the Experience by the will of the Customer, the latter will be entitled to a refund of the amount paid in the following cases:
a) the Host is unable to carry out the Experience or shows up more than 15 minutes later than the indicated start time;
b) the Host makes significant changes to the Experience once the booking has already been made;
c) the Experience presents a risk to safety or health that can negatively affect the participation by the Customer;
d) the Customer cannot participate or the Host cannot conduct the Experience due to technical problems, including audio or visual problems, not dependent on the Customer.
With reference only to letters b, c) and d) MYFassa Plus reserves the right to provide a refund at its discretion, determining the amount based on the nature of the problem encountered, which the customer must document, up to a maximum of the total costs paid by the customer for the experience.
In case of cancellation of the experience by the Host, the Customer will be notified with a specific notification as soon as the cancellation is reported and will be refunded in full, or will be able to book another Experience.
For all the above hypotheses, MYFassa Plus, through MarshYellow di Daniele Schimizzi, undertakes to make refunds within 7 working days of the request.
These reimbursement conditions do not represent nor are to be understood as an offer of insurance, do not constitute a policy or an insurance contract, do not replace the insurance obtained and / or obtainable by the Customer and do not provide for the payment of any premium by this ‘last.
MYFassa Plus reserves the right to modify these reimbursement conditions at any time and at its sole discretion, promptly communicating it within the Platform and notifying already registered Customers.

7- SECURITY AND CONFIDENTIALITY OF DATA

The Customer guarantees that he legitimately has all the information entered on the website www.myfassaplus.com for the purpose of purchasing the Experience and accessing the related service, also ensuring that they do not violate in any way, directly or indirectly, the right of third parties.
The Customer undertakes not to enter data which he cannot freely dispose of.
It is forbidden for the Customer to enter false and / or fictional data in the registration and purchase procedure of the Experience and in subsequent further communications related to the performance of the same.
The Customer expressly authorizes the use of the data entered as well as the data automatically detected during the course of the Experience.

8- INFORMATION AND CONSENT TO THE PROCESSING OF PERSONAL DATA

In compliance with GDPR 679/16, MarshYellow di Daniele Schimizzi, owner of the MYFassa Plus project and its platform, undertakes to process all personal data acquired in relation to this contract in compliance with the legislation on confidentiality.

The Customer declares to have been informed, pursuant to art. 13 of Legislative Decree no. 196/2003, art. 13 and 14 of EU Regulation no. 679/2016 and subsequent amendments, that their personal data provided for the conclusion and execution of this agreement and for the provision of the service in question, will be subject to manual and electronic processing, in compliance with suitable security and protection measures. of the same data, for the aforementioned purposes, as well as for the fulfillment and execution of the obligations assumed with the agreement and those provided for by the laws of the State, the Regulations and the Community legislation, to this by giving your consent.
With the purchase of the Experience, and consequential adherence to these General Conditions, the user consents to the registration of his image for the duration of the Experience and to the possible use by MarshYellow of Daniele Schimizzi and exposure inside of the MYFassa Plus platform of one or more images taken from the service requested for promotional / commercial purposes, providing the relative release for this purpose.
The person in charge of data processing is MarshYellow di Daniele Schimizzi and for it its owner and legal representative Mr. Daniele Schimizzi.
